These Terms govern your use of the HeatMap Baseball service (the "Service"), operated by HeatMap Baseball ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Who you contract with

You are contracting with HeatMap Baseball, the seller of the Service.

2. Eligibility

You must be of legal age in your jurisdiction (or have a parent/guardian's consent) and have authority to bind any organization on whose behalf you use the Service.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or abusive purpose;
  • Infringe anyone else's intellectual property or privacy rights;
  • Upload malware, attempt to probe, scan, or breach security, or scrape the Service;
  • Reverse engineer, resell, or redistribute the Service or circumvent technical limits.

4. Your account and content

You are responsible for keeping your credentials confidential and for activity under your account. You retain ownership of video clips and content you upload; you grant us a limited license to host and process that content solely to provide the Service.

5. Intellectual property

The Service, including software, models, branding, and documentation, is owned by HeatMap Baseball and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

6. Service availability

We work to keep the Service reliable, but we do not guarantee uninterrupted or error-free performance. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payment, subscriptions, taxes, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing cycles, renewals, taxes, and refunds are governed by Paddle's Buyer Terms in addition to these Terms and our Refund Policy.

Pro subscriptions renew automatically until cancelled. If you cancel, you keep Pro access until the end of your current paid period, then revert to the free tier.

8. AI and analysis disclaimer

The Service uses computer vision and machine learning to estimate pitch speed, type, and spin. Outputs may be inaccurate and are provided for informational and training purposes only. They are not a substitute for professional coaching, medical advice, or officiating.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability under these Terms is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold HeatMap Baseball harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the seller's jurisdiction, without regard to its conflict-of-law principles.
